Two employers fined for breaching MPFS Ordinance

Two employers were fined a total of $8,000 at the Kwun Tong Magistracy today (15 July), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (the "Ordinance").

Kudos Knitting (HK) Company Limited (BR no.: 30046272), which has committed an offence under section 7(1A)(b) of the Ordinance, was convicted of one count of failing to enrol an employee in an MPF scheme as required by the Ordinance. The defendant was fined $4,000.

Wide Fancy International Limited (BR no.: 35295956), which has committed an offence under section 7(1A)(b) of the Ordinance, was convicted of one count of failing to enrol an employee in an MPF scheme as required by the Ordinance. The defendant was fined $4,000.

The MPFA also pursued a claim in the Small Claims Tribunal for some $29,000 on behalf of an employee, who was owed MPF contributions by his employer.

At the Tribunal's hearing today, the defendant Keytech Industries Limited did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA a sum of $29,224.96, being mandatory contributions in arrears and surcharges payable.

The amounts awarded at the Tribunal will be reimbursed to the employee's MPF account as soon as it was received by the MPFA. The Tribunal ordered the defendant to pay $202 as the cost of the claim.
