NON-COMPLIANT EMPLOYER AND OFFICER RECORDS

The MPFA has set up the Non-Compliant Employer and Officer Records ("NCEOR") in May 2011 with a view to further enhancing the deterrent effect on non-compliant employers and officers as well as increasing the transparency of the MPFA's enforcement actions. Using the NCEOR, members of the public can view and search for information on employers and officers with MPF non-compliance records resulting from legal proceedings initiated by the MPFA.[1]

The NCEOR comprises two parts. The first part contains records of both criminal convictions and civil awards/judgments in connection with the violation of the Mandatory Provident Fund Schemes Ordinance ("MPFSO") by employers (including limited companies and individuals such as sole-proprietors or partners) or their officers.

The second part of the NCEOR contains records of repeated offenders. Employers and/or their officers who have been convicted of offence(s) under the MPFSO on two or more dates will be shown under this section.

If an employer or an officer has no further MPF non-compliance within five years (including any substantiated MPF non-compliance that may not have proceeded with civil or criminal proceedings) since the last posted record, all past non-compliance record(s) of the employer or officer will be removed from the NCEOR at the end of the relevant month.

Members of the public may search the NCEOR by date range, company name or business registration number.

[1] At launch, the NCEOR contains non-compliance records dated from 24 May 2006 and the names of individual defendants have been masked with "XXX". New non-compliance records posted after the launch of the NCEOR on 23 May 2011 will include the names of individual defendants.
