Change of Scheme Particulars

The ORSO requires the relevant or representative employer to notify the MPFA within one month of any change to the following:

 

  • the relevant or representative employer;
  • administrator;
  • scheme name; or
  • name and address of relevant or representative employer.

 

ORSO also requires the designated person of a registered scheme to notify the MPFA of any change of the name or address of the designated person or administrator of the scheme previously supplied to the MPFA within one month of the change.

 

The following forms are to be used for notification of the relevant changes:

a. Change of scheme name
The relevant employer or the representative employer of a group scheme shall use a specified form to notify the MPFA of a change to the scheme name. Please complete the form:

b. Change of relevant employer by way of replacement
Where the relevant employer of a scheme is replaced by another relevant employer (including, in the case of a group scheme, another existing relevant employer of the scheme) who undertakes, with effect from the date of the change, the obligations of the original relevant employer in relation to the scheme, notice of change shall be given to the MPFA. Please complete the form:

Employers are required to provide a copy of any document evidencing the change (e.g. written agreement between the original relevant employer, succeeding relevant employer and scheme members, if appropriate, evidencing the consent to the change of the relevant employer) together with the completed form.

 

For a group scheme in which the succeeding relevant employer is a new relevant employer and not an existing relevant employer of the scheme before the change of relevant employer, the succeeding relevant employer is required to provide a Power of Attorney to nominate the representative employer of the scheme:

c. Change of relevant employer not involving replacement
Where a relevant employer from within a grouping of companies joins or withdraws from a scheme when no replacement is involved, the relevant employer shall use a specified form to notify the MPFA of the change. Please complete the form:

d. Change of name and/or address of the relevant or representative employer

These forms are for notification of change of name and/or address only, and should not be used for notification of change of legal entity of the relevant or representative employer.

 

For a registered scheme in which there is a change of name and/or address of a relevant employer or representative employer, the relevant employer or representative employer concerned shall use a specified form to notify the MPFA of the change.

 

For an exempted scheme, the relevant employer or in case of a group scheme, the representative employer, shall use a specified form to notify the MPFA of the change. Please complete the form:

A copy of the certificate or document evidencing the change of name of the relevant employer or representative employer is required to be provided together with the completed form.

e. Change of administrator of a registered scheme

*applicable to registered scheme only

 

In the case of a change of administrator, the relevant employer or the representative employer of a group scheme shall use a specified form to notify the MPFA of the change.

 

For a registered scheme with an MPF exemption certificate where the trustee to be appointed is not an RTC, an application for approval of appointment or retirement of trustee shall be made to the MPFA before retiring or appointing the trustee. Please complete the form:

A new trustee who is ordinarily resident in Hong Kong and is the holder of a Hong Kong identity card within the meaning of the Registration of Persons Ordinance (Chapter 177, Laws of Hong Kong), or is a body corporate having a place of business in Hong Kong, should provide an undertaking stating that he/it shall perform the functions imposed or conferred on a designated person by the ORSO.

 

The retiring trustee should make an application for releasing his undertaking to perform the functions imposed or conferred on a designated person by the ORSO.

Change in Domicile

 

Where the domicile of a registered scheme changes, the designated person shall notify the MPFA in writing of the change. Download a Quick Reference Guide 

f. Change of name and/or address of the scheme administrator or designated person of a registered scheme

*applicable to registered scheme only

 

For a change of name and/or address of the scheme administrator or designated person not caused by change of legal entity, the designated person shall use a specified form to notify the MPFA of the change. Please complete the form:

A copy of the certificate or document evidencing the change of name of the administrator or designated person is required to be provided together with the completed form.

g. Change of representative employer of a group scheme
For a change of representative employer of a group scheme, the representative employer shall use a specified form to notify the MPFA of the change. Please complete the form:

Each of the relevant employers of the group scheme is required to provide a Power of Attorney nominating the representative employer of the scheme:
