Employer who repeatedly defaulted on MPF contributions was fined $120,000
An employer who was repeatedly convicted of offences under the Mandatory Provident Fund Schemes Ordinance was earlier fined $120,000 in Kwun Tong Magistrates’ Court for failing to make Mandatory Provident Fund (MPF) contributions totalling $14,103.
The court heard that the employer had failed to make $14,103 in MPF contributions for an employee from January to October 2015. Taking into account the fact that the employer had previously been convicted of defaulting on MPF contributions and fined $36,000 and $16,000 in 2014 and 2015 respectively, the court imposed a severe punishment.
The Mandatory Provident Fund Schemes Authority (MPFA) reminds employers that it is an offence to default on MPF contributions. Employers who commit such an offence are subject to a maximum penalty of a fine of $450,000 and imprisonment of four years. The MPFA appeals to employers to make MPF contributions on time.
The MPFA also reminds employees that if they suspect their employers have failed to make contributions, they should not hesitate to contact the MPFA to lodge a complaint.
