Dear Sirs,


Provision of Documents/Information to Scheme Participants


The Authority would like to remind you of certain requirements in the MPF legislation pertaining to the captioned subject.


Notice of Acceptance


Pursuant to section 31(4) of the Mandatory Provident Fund Schemes (General) Regulation (the "Regulation"), you must provide a scheme applicant with a notice of acceptance within 30 days from the date on which the applicant submits all the information required for the application for membership of or participation in the scheme, or from the date on which the applicant agrees to observe and accept the governing rules of the schemes, whichever is the later.


Information to Scheme Members / Membership Certificates to Relevant Employees


According to section 54 of the Regulation, you must provide a scheme member with a document containing information relating to the scheme concerned within 60 days of the person becoming a scheme member. The document must include a general description of the scheme, including its terms and the fees and charges payable, and the particulars of the constituent funds, and specify the scheme contact person. In respect of relevant employees, the document may be distributed through the participating employer, in which case, you should remind the employer to give the document to the member within 7 working days of receipt.


Section 55 of the Regulation requires that you must provide a membership certificate to the relevant employee of a participating employer within 60 days of the employee becoming a member of the scheme (except for a casual employee becoming a member of an industry scheme). The membership certificate must specify certain details of the scheme as set out in section 55(2). As in the case above, the certificate may be distributed through the participating employer, and if so, you should again remind the employer to give the certificate to the member within 7 working days of receipt.


Participation Certificates


The Authority issues participation certificates to participating employers through approved trustees. Pursuant to section 124(2) of the Regulation, you must ensure that the participation certificate is given to the participating employer within 7 working days after you receive it.


As the deadline for enrolment draws near, employers, relevant employees and self-employed persons will be keen to know that their applications are being promptly processed. The Authority has received complaints that they have not received the relevant document from the trustees concerned even though the prescribed timeframe has already elapsed. You should therefore ensure that you have sufficient resources to process the enrolment applications and to issue the relevant documents according to the timeframe prescribed in the legislation. Breaching the relevant provisions could result in the imposition of financial penalties by the Authority.
